Terms of Use
Sensity is an app developed by Insp Mobile, a company registered under the laws of the Republic of Cyprus, with its registered office at Themistokli Dervi 6, Flat/Office 4D, 1066, Nicosia, Cyprus.
These Terms govern your download, access to, and use of the Sensity application (the “Application”) and any related features, content, websites, and services provided with it (collectively, the “Services”). By downloading or using the Application, or using the Services, you agree to all of the terms and conditions contained herein. If you do not agree, stop using the Services and the Application and immediately remove the Application from your device.
These Terms contain important provisions, including disclaimers of warranties, limitations of liability, and mandatory arbitration and class action waiver.
1. Acceptance of Terms and Privacy Policy
1.1 Binding agreement. By accessing or using the Application or Services, you agree to be bound by these Terms, which form a legally binding contract between you and Insp Mobile.
1.2 Privacy Policy. Please review our Privacy Policy. By using the Services, you consent to the collection, use, and disclosure of information as described in the Privacy Policy, which is incorporated by reference into these Terms.
1.3 Third-party terms. You agree to comply with and be bound by any applicable third-party licenses and conditions when using the Application, including any app store terms (e.g., Apple’s Terms of Use, where applicable).
1.4 Translations. Any translation from the English version is provided for convenience only. In the event of any discrepancy, the English version will prevail and is the sole legally binding version.
2. Eligibility (18+)
2.1 Adults only. The Application and Services are intended for users over the age of 18. You may access and use the Application and Services only if you are 18 years of age or older. By using the Services, you represent and warrant that you meet this requirement.
3. Account Registration and Security
3.1 Account may be required. Some features may require you to register an account and provide certain information.
3.2 Accurate information. You agree that information you submit is truthful and accurate, and you will maintain its accuracy.
3.3 Account security. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. Notify us promptly of any unauthorized use or suspected breach.
3.4 Suspension/termination. We may suspend or terminate your account or your access to the Services at any time, with or without notice, if you breach these Terms or if we reasonably believe your use creates risk for us, the Services, or other users.
4. The Services and Acceptable Use
4.1 Prohibited content and conduct. You agree not to upload, send, transmit, or otherwise make available:

pornography;

violent, bloody, offensive, illegal, or otherwise inappropriate content;

copyright-infringing content; or
-
any content that violates applicable law or these Terms.
What constitutes prohibited or inappropriate content will be determined solely at the discretion of the Sensity developers.
4.2 No illegal or malicious use. You may not use information obtained from our app or users in an illegal or malicious manner.
4.3 Respect other users. You may not restrict or attempt to restrict the rights of other users to use the Services, and you may not encourage or assist others in using the Application in a way that violates these Terms.
4.4 Service changes and availability. The Services may be modified, updated, interrupted, suspended, or discontinued at any time, with or without notice and without liability to you, to the maximum extent permitted by law.
4.5 Your equipment and access. You are responsible for obtaining and maintaining any devices, software, and internet connectivity required to access the Services and for all associated costs.
4.6 Enforcement. If Sensity determines that you intentionally or unintentionally violate these Terms, Sensity may stop providing Services to you and, if necessary, take legal action to protect the rights of Sensity and its users.
5. License Restrictions and Intellectual Property
5.1 Limited license. Subject to these Terms, Insp Mobile grants you a personal, non-transferable, non-exclusive, revocable license to use the Application and Services for your personal, non-commercial use.
5.2 No commercial use; no redistribution. You may not rent, lease, lend, sell, redistribute, or sublicense the Application and/or Services, or use them for any commercial purpose.
5.3 No reverse engineering. You may not copy (except as expressly permitted by this license and Apple’s Terms of Use, where applicable), decompile, reverse engineer, disassemble, attempt to derive source code from, modify, or create derivative works of the Application and/or Services (including updates or any portion thereof), except and only to the extent such restriction is prohibited by applicable law or permitted by applicable licensing terms. Any attempt to do so violates the rights of the Application Provider and its licensors, if any.
5.4 Our IP. All text, images, marks, logos, compilations, software, and other materials provided through the Services (excluding User Content) are owned by or licensed to Insp Mobile or its licensors and are protected by intellectual property laws. No rights are granted to you except as expressly stated in these Terms.
6. User Content
6.1 Your content. If you submit content to the Services (“User Content”), you retain ownership of your User Content.
6.2 License to us. You grant Insp Mobile a non-exclusive, worldwide, transferable, perpetual, irrevocable right to host, store, use, reproduce, modify (for technical purposes such as formatting), publish, distribute, publicly display, and perform your User Content in connection with operating, improving, and providing the Services and as described in the Privacy Policy.
6.3 Responsibility. You are solely responsible for your User Content and for ensuring it does not violate these Terms or any law. We do not control User Content and are not responsible for it.
7. Third-Party Links, Ads, and Dealings
7.1 The Services may contain third-party links, resources, or advertisements (“Third-Party Ads”). We do not control and are not responsible for Third-Party Ads, their content, or your dealings with them.
7.2 Your interactions and transactions with third parties are solely between you and the third party, and you assume all risk arising from such interactions.
8. Payments, Subscriptions, Cancellation, and Refunds
8.1 Paid features and subscriptions. Some parts of the Services may be offered for a fee. You may purchase subscriptions that provide access to premium features.
8.2 Pricing and changes. Subscription tiers and pricing are displayed at the point of purchase and may change from time to time. Changes apply as permitted by applicable law and platform rules.
8.3 Authorization and auto-renewal. When you purchase a subscription, you authorize us (and/or our payment processors) to charge you. Subscriptions may automatically renew at the end of each subscription period unless you cancel.
8.4 How to cancel. You can cancel your subscription by contacting us via email at [email protected]. If you cancel, you will still be charged for the subscription period in which you canceled, but you will not be charged for any subsequent subscription period.
8.5 Orders and billing. We may refuse or cancel orders in our sole discretion and may attempt to notify you using the contact information you provided.
8.6 Refund policy (general rule). All payments are non-refundable, except as required by law, and subject to any applicable app store or platform refund rules where you purchased your subscription.
8.7 Money-Back Guarantee (when presented at checkout). This money-back guarantee complements any legal refund rights you may have. If you made a purchase directly through a checkout flow where a money-back guarantee was presented at the time of purchase, you may be eligible for a refund if:

you contact us within 30 days of your initial purchase and before the end of your first subscription period; and
-
you have followed the program for at least 14 consecutive days within the first 30 days after purchase; and
-
you provide reasons and evidence for requesting a refund that go beyond personal or financial reasons (e.g., defective or inaccurate content, dissatisfaction with the product, unmet expectations); and
-
you can prove you followed the program by submitting screenshots showing completion of 14 consecutive days.
8.8 Discounts and testing. We may offer different subscription packages, durations, pricing, trials, or discounts (including for testing). Discount terms may be provided separately and may change or be discontinued.
9. Limited Warranty
9.1 Sensity does not represent or warrant that the Application will operate without interruption or be error free, especially in the following cases:

modification or alteration of the app made without the prior written approval of Sensity;

accident, neglect, misuse, or abuse; or
-
exposure to conditions outside the range of environmental, power, and operating specifications provided by Sensity.
10. Disclaimer – No Medical Advice; Informational Purposes Only
10.1 The Services are for informational purposes only and do not include or constitute medical advice, diagnoses, treatment, opinions, or healthcare services. No doctor-patient relationship is created by use of the Services. The Services are not intended for medical emergencies and may not be suitable for everyone.
10.2 You must not rely on the Services as an alternative to medical advice from a doctor or other qualified healthcare professional. If you have any questions about a medical matter, consult a healthcare professional. If you think you may be suffering from a medical condition, seek immediate medical attention. Do not delay seeking medical advice, disregard medical advice, or discontinue medical treatment because of information provided through the Services.
10.3 We do not warrant that any Content will be constantly available, available at all, true, accurate, complete, current, or non-misleading.
11. Privacy and Security
11.1 Data processing and transfer. By using the Services, you consent to the collection, use, and disclosure of your personally identifiable information and aggregate data as set forth in our Privacy Policy, including having your personally identifiable information collected, used, transferred to, and processed in the United States.
11.2 Security. We care about the integrity and security of your personal information, but we cannot guarantee that unauthorized third parties will never be able to defeat our security measures or use your information for improper purposes. You provide personal information at your own risk.
12. Disclaimer of Warranties
12.1 The Services are provided on an “AS IS” and “AS AVAILABLE” basis. To the maximum extent permitted by law, we disclaim all warranties and conditions of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, quiet enjoyment, accuracy, and non-infringement.
12.2 We do not warrant that the Services will meet your requirements or be uninterrupted, secure, or error-free. No advice or information (oral or written) obtained from us creates any warranty not expressly stated in these Terms.
13. Limitation of Liability
13.1 No indirect damages. To the maximum extent permitted by law, in no event will Insp Mobile (including its affiliates, directors, employees, or agents) be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including loss of profits, goodwill, use, or data, arising out of or relating to your use of, or inability to use, the Services.
13.2 Specific exclusions. To the maximum extent permitted by law, we assume no liability for:

errors, mistakes, or inaccuracies of any content;

personal injury or property damage resulting from your access to or use of the Services;
-
unauthorized access to or use of servers and/or personal information stored therein;
-
interruptions or cessation of transmission to or from the Services;
-
bugs, viruses, trojan horses, distributed denial of service attacks, malware, or similar harmful material transmitted to or through the Services by any third party;
-
any loss or damage incurred from your use of content made available through the Services; or
-
User Content or the defamatory, offensive, or illegal conduct of any third party.
13.3 Service disruptions. We are not responsible for disruption or non-availability resulting from external causes, including ISP failures, hosting failures, communications network failures, natural events, acts of war, legal restrictions, or censorship.
13.4 Liability cap. To the maximum extent permitted by law, our total liability to you for any claims arising out of or relating to these Terms or the Services will not exceed the greater of: (a) the amount you paid to Insp Mobile for the Services in the 12 months before the event giving rise to the claim, or (b) $100.00.
13.5 Basis of claim. These limitations apply whether liability is based on contract, tort, negligence, strict liability, or any other legal theory, even if we have been advised of the possibility of damages.
14. Indemnity
You agree to indemnify, defend, and hold harmless Insp Mobile and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising from your violation of these Terms, your misuse of the Services, or your User Content.
15. Mandatory Binding Arbitration and Class Action Waiver
Please read this section carefully. It affects your legal rights.
15.1 Arbitration required. Except where prohibited by law or where a claim may be brought in small claims court, you and Insp Mobile agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Services, or the Privacy Policy will be resolved exclusively by final and binding confidential arbitration.
15.2 Waiver of jury trial and class actions. You waive the right to a trial by jury and agree to bring claims only in your individual capacity, not as a plaintiff or class member in any purported class, representative, or consolidated proceeding. The arbitrator may not consolidate claims or preside over any class or representative proceeding.
15.3 Notice and informal resolution. A party intending to seek arbitration must first send written notice of the dispute (“Notice”) describing the basis of the claim and the relief sought. If the parties do not resolve the dispute within 30 days after the Notice is received, either party may commence arbitration.
15.4 Administrator and rules. The American Arbitration Association (“AAA”) will administer the arbitration under its Commercial Arbitration Rules and the Supplementary Procedures for Consumer Related Disputes, as modified by these Terms.
15.5 Process and location. The arbitration will be conducted in English. Unless otherwise required by law, arbitration may be conducted online and/or based on written submissions, at the initiating party’s election. A single arbitrator will be appointed under AAA rules.
15.6 IP exception. Either party may seek equitable relief to protect its copyrights, trademarks, patents, or other intellectual property. Except for that limited purpose, arbitration is the exclusive remedy.
15.7 Time limit to file. To the fullest extent permitted by law, any claim (excluding a claim for indemnification) must be initiated in arbitration or small claims court within one (1) year after the claim accrues; otherwise it is permanently barred.
15.8 Severability. If any part of this arbitration section is found unenforceable, the remainder will remain in effect to the fullest extent permitted by law.
16. Governing Law and Venue
16.1 Governing law. These Terms and any dispute arising out of or relating to them or the Services will be governed by the laws of the State of New York, excluding its conflicts of law principles, to the extent permitted by applicable law.
16.2 Court venue where allowed. To the extent a dispute is permitted to be brought in court (for example, small claims court or intellectual property enforcement), it will be subject to the exclusive jurisdiction of the state and federal courts located in New York, New York, and you consent to personal jurisdiction and venue there, and waive defenses of improper venue or inconvenient forum, to the extent permitted by law.
17. Changes to These Terms
We may update these Terms at any time. Changes are effective when posted in the Application or on the Services. Your continued use after posting means you accept the updated Terms. Unless otherwise required by law, we will indicate changes by updating the “Last Updated” date.
18. Electronic Communications
By using the Services and communicating with us electronically (including email and in-app communications), you consent to receive communications electronically. Clicking buttons such as “SUBMIT,” “CONTINUE,” “ADD TO CART,” “PAY,” or similar constitutes a legally binding electronic signature.
19. Miscellaneous
19.1 Entire agreement. These Terms (together with the Privacy Policy and any supplemental policies posted in the Services) are the entire agreement between you and Insp Mobile regarding the Services and supersede prior agreements on the same subject.
19.2 Severability. If any provision is held invalid or unenforceable, the remainder remains in full force, and the provision will be reformed to reflect the parties’ intent to the maximum extent permitted by law.
19.3 No waiver. Failure to enforce any provision is not a waiver of the right to enforce it later.
19.4 Assignment. Insp Mobile may transfer or assign its rights and obligations under these Terms to another entity, including by novation, and you consent to such transfer. Posting an updated version identifying another entity as the provider constitutes notice, unless otherwise indicated.
19.5 Force majeure. We are not liable for failure to comply with these Terms to the extent caused by factors outside our reasonable control.
